Legal and administrative framework

Abstract

The Act of 5 May 2006 relating to asylum and other forms of protection (Loi du 5 mai 2006 relative au droit d’asile et à des formes complémentaires de protection) was published in Mémorial, A-No 78 of 9 May 2006, p. 1402. It contains provisions relevant for resettlement, namely the following Articles in Chapter 4 on international protection:

-Non-refoulement : Article 43

-Family unity : Article 45

-Residence permit (three years renewable for conventional refugees and one year renewable for beneficiaries of subsidiary protection): Article 46

-Travel Document : Article 47

-Right to work and professional training (on equal basis with Luxembourg nationals): Article 48

-Right to education, diploma recognition (on equal basis with Luxembourg nationals for refugees and on equal basis with non-nationals residing regularly for beneficiaries of subsidiary protection): Article 49

-Right to social welfare (on equal basis with Luxembourg nationals): Article 50

-Right to healthcare (on equal basis with Luxembourg nationals): Article 51

-Access to integration programme: Article 55
