Greece

Greece lacks a legal basis for resettlement. Nevertheless, there is no legal disposition forbidding resettlement.

The Law (3907/2011) establishes the Asylum Service and the Service of First Reception in Greece, while the Decree (114/2010) introduces a uniformed procedure for identification of the status of refugee or of subsidiary protection for aliens and stateless.

Abstract

The Law of 26 January 2011 (Official Journal No 7) concerns the establishment of the Asylum Service and the Service of First Reception (transposition of the directive 2008/115/EC). This Law is not used in practice. The reason is the delay in the establishment of the Asylum Service as proscribed by the law.

Note well, that Article 5 of the Law states that the Asylum Service is competent for ‘every process of attribution of the refugee status, its content, and the procedures of temporary protection attribution’. This disposition could potentially be used as a basis for further involvement of the Asylum Service in resettlement activities.

Abstract

The Presidential Decree of 22 November 2010 (Official Journal No 195) concerns the ‘Establishment of a uniformed procedure of identification of the status of refugee or of subsidiary protection for aliens and stateless in compliance with Directive 2005/85/EC ‘on minimum standards on procedures in Member States for granting and withdrawing refugee status’ (L326/13.12.2005)’.

Note well that, although the Law on establishment of the Asylum Service and the Service of First Reception (3907/2011) has been voted in order to replace this Decree, it is still used (as of May 2012), due to the delay in the setting up of the Asylum Service.
