The Act concerning Settlement and Residence (2005) contains the preconditions for the issuance of residence and settlement permits, while the Act Concerning the Granting of Asylum (2005) defines the asylum and subsidiary protection statuses of foreigners. There is no specific reference to resettlement in the Austrian legal basis.

Abstract

The Federal Act concerning Settlement and Residence (Niederlassungs- und Aufenthaltsgesetz) contains the preconditions for the issuance of residence and settlement permits, including for humanitarian reasons and for displaced persons. Article 8 specifies the difference between the residence and settlement permit. The former is a non-permanent limited residence title while the latter is a long-term residence title. The Act also regulates the integration course offer for persons entitled to settle.

* Federal Act Concerning the Granting of Asylum (2005)

Abstract

The Federal Act Concerning the Granting of Asylum (Asylgesetz 2005) was published in the Federal Law Gazette (FLG) I No. 100/2005. It defines the asylum and subsidiary protection statuses of foreigners, as well as general procedures for these statuses. Provisions on status preconditions and on the granting ex officio (from which follows the recognition of the refugee) are contained in § 3:

(4) An alien shall be granted asylum status ex officio without any further procedure if the Republic of Austria has undertaken to do so under international law.

(5) The ruling whereby an alien is granted asylum status ex officio or on the basis of an application for international protection shall be issued in conjunction with a declaration that refugee status is accordingly conferred upon the alien by operation of the act.

This Act (Bundesgesetz, mit dem die Grundversorgung von Asylwerbern im Zulassungsverfahren und bestimmten anderen Fremden geregelt wird (Grundversorgungsgesetz - Bund 2005 - GVG-B 2005) contains provisions on the accommodation, feed and basic medical care of people with an asylum procedure pending and those who have been granted the asylum status.

* Aliens Police Act (2005)

This is a Federal Law on the exercise of the foreigners’ police, the granting of documents for aliens and entry permits (Bundesgesetz über die Ausübung der Fremdenpolizei, die Ausstellung von Dokumenten für Fremde und die Erteilung von Einreisetitel (Fremdenpolizeigesetz 2005 - FPG). The Act contains provisions about the legal entry and stay of Aliens in Austria, the issuance of visa as well as the competences of the Aliens Police. An important provision is the prohibition of refoulement in § 50.
